Welcome to the user agreement for Savile Rogue.

In return for allowing you to access this website we require you agree to these terms and conditions which are governed by English law. If you do not agree to them, you may not use and access this website. The Savile Rogue website is provided solely for your personal, non-commercial use. You may not use this website for any commercial purpose. Please read the following Terms and Conditions carefully before placing an order with www.Savile-Rogue.com. We may modify the Terms and Conditions from time to time, so please read them carefully and check back often.

Registering
While using www.Savile-Rogue.com in order for you to access some of the features of the website we may require you to register. You will be asked to provide information about yourself that true, accurate, current and complete in all respects. Should any of your information change please update your information in the My Account section.

We reserve the right to change the registration process at any time.

Ordering eligibility
For you to safely make an order through www.Savile-Rogue.com you will be requested to register and provide personal details. Customers will be asked to provide their real name, telephone number, e-mail address and other requested information. When ordering items from the site your will be required to provide payment details and warrant that the details you provide upon ordering are correct and valid. You must be able to confirm that you are the said person as referred to in the billing information.

The site’s ordering processes will only be available to those who have been issued a valid credit/debit card by a bank that is acceptable to Savile Rogue and who have authorised Savile Rogue to process a charge or charges to a card in the amount of the total purchase price.

By making an offer to purchase, you authorise Savile Rogue to perform the necessary credit checks, to transmit or obtain information about you to or from third parties. This will be done in the interest of authenticating your identity, to validate your credit/debit card, to obtain payment authorisation and to authorise the individual purchase transaction.

Ordering
All orders are subject to acceptance and availability.

When you place an order with Savile Rogue, at the checkout process you will be able to check your order and correct any errors.  We will send you an order confirmation detailing the products you have ordered. Please note that items in your shopping basket are not reserved and maybe purchased by other customers.

Acceptance of your Order
Our acceptance of your order takes place when we dispatch the order.  We will initially send you a dispatch confirmation by email, which is not classed an acceptance but as a confirmation for receipt of your order. Only when we dispatch the order will the purchase contract between you and Savile Rogue be made, even if your payment has been processed immediately, unless we have notified you that we do not accept your order or you have cancelled your order.

We may refuse to accept your order in the following circumstances

1. where goods are not available

2. where we can not obtain authorisation for your payment

3. if there has been a pricing or product description error

4. if you do not meet any eligibility criteria set out in our terms and conditions.

The display of any item on our website is not an offer to sell and Savile Rogue shall be under no obligation to supply the products ordered through this website. If you place an order, this will be your offer to purchase the items from us. We will acknowledge your order as soon as possible but will be under no obligation to supply the products ordered unless we have the products in stock and they are available at the prices specified.

If items that you order are out of stock, subject to a delay or the price is higher than that shown on your order, we will try to contact you at the email address you provided when placing your order. If we cannot contact you or receive no response to our email, we will continue to process the remaining items on your order. We will not supply a substitute product without your express authority.

Descriptions and Product Information
All products displayed on this website are available only whilst stocks last. Every effort has been made to reflect product colours as accurately as possible. However, due to factors such as differences in monitors and screen settings, we are unable to guarantee that the colour you will see on your monitor will accurately reflect the true colour of the product.

Sizes of products can vary from one batch to the next. All drawings, photos, descriptions and specifications are issued or published for the sole purpose of giving an approximate idea of the products described in them. They will not form part of the contract with you and no warranty or guarantee shall be expressed or implied in the contract with you in this regard.

Pricing
The prices displayed on this site may be quoted in GB Pounds, Euros and US Dollars. Our currency converter feature is intended for guidance only – all orders will be made in Great British Pounds. Our currency rates are updated regularly from the rates published by the European Bank but are subject to variance from one bank to another.

All prices on the website shown in GBP are inclusive of VAT at the current rates, unless you have selected an alternative country where VAT is not charged.  We reserve the right to express the price exclusive of VAT.

Where products are delivered to you outside of the European Union a VAT deduction will be applied within the checkout upon entering a valid delivery address, and your package will be sent DDU (Delivery Duty Unpaid); you will be responsible for paying any local sales tax or import duties arising at the delivery destination, which are not included in the price of the products. Import duty or tax costs will be invoiced directly to you from your postal service, DHL or an import broker. We recommend you contact your local customs authority to determine a landed cost price prior to order completion.

Where we charge separately for packing, carriage and insurance and other relevant charges, the appropriate rates are set out in our specified pricing structure shown elsewhere on this website.

We will from time to time apply reductions against the normal prices of selected goods and/or their shipping costs. We may do this by applying promotional codes to the listings of those goods on the website, in which case the deductions will be labelled on the site and applied automatically at the checkout stage of your purchase transaction.

We reserve the right at all times and at our sole discretion to refuse to accept any orders.
If you exercise a right to cancel your order but the goods have already been dispatched, please follow the Returns Procedure set out below, which also governs refunds.

Payment
Payment can be made securely online by Visa, Master Card credit cards or Switch/Maestro debit cards or Paypal. You may also place your order through telephone on 44 (0) 207 11 88 765. The credit/debit card that is being used must be yours. All credit/debit cardholders are subject to validation checks and authorisation by the card issuer. If the issuer of your payment card refuses to authorise payment, we will not be liable for any delay or non-delivery of your order. We also reserve the right to cancel your order. For first time online customers, we may request that shipping be to the credit card billing address only.

By submitting an order to us through our website you represent and warrant that the payment details provided on your order are valid and correct and that when your order is accepted and processed by us, payment will be made in full.

If the billing details for your order are the same as your delivery address details, by placing an order on the website you confirm that you are the person referred to in the delivery address details. Otherwise, by placing an order, you confirm that you are the person referred to in the billing details.

Delivery and Insurance
Delivery times are approximate and are subject to stock availability, and to possible delays due to credit card authorisation, compliance with customs controls and other factors outside our control.

We will only ship to countries featured in our shipping list and will not honour orders requiring delivery to any destination outside the countries listed. Please note that we do not ship to PO Boxes.

During the checkout process, if an incorrect destination country is selected, or the address entered doesn't correspond to the country selected, the order will be cancelled and a notification of cancellation will be sent automatically to your nominated email address.

Savile Rogue insures each purchase during the time it is in transit until delivered to your specified delivery address. We require a signature for any goods delivered, at which point the responsibility of your purchased goods passes to you. Should you request a specified recipient who is not you (as a gift) then you accept that evidence of a signature by them at at that address is evidence of delivery and fulfilment by Savile Rogue and transfer the responsibility in the same way.

Savile Rogue aims to dispatch all orders with one working day. Estimated delivery times are to be used as a guide only and commence from the date of dispatch. We are not responsible for postal services delays in delivery and are not able to compensate customers for late deliveries. If you select a next day service and your order arrives later than the suggested time we may compensate for the difference between this service and the non-guaranteed service at our discretion. 

Tracking your Order
You may request your Royal Mail tracking number by email. 

Returns/Exchange Policy
We request that items returned to us are protected and insured during transit to Savile Rogue.

Unsuitable items may be refunded or exchanged within 14 days of receipt (although we extend this period for Christmas gift purchases). Before you return your purchase you must notify us by emailing us at info@savile-rogue.com. Please include your original delivery note in the returned parcel. If you prefer, you can contact one of our customer care representatives who will be happy to talk you through our returns procedure, simply call 44 (0) 207 11 88 765.

Please send all returns to Savile Rogue, c/o James & James, Dale Manor Business Park, Grove Road, Sawston, Cambs, CB22 3TJ, United Kingdom.  The product you return must be in new, unused, and unworn condition with all the original packaging and garment tags still attached. We do not accept any item with any indication that it was used. In such cases, the item will be returned to the purchaser.

If an item arrives faulty you must notify us within 7 days and the returned item must not be worn. Faulty items will be exchanged and the returns postage will be met by Savile Rogue.

If you wish to receive a refund we will re-credit the original purchaser's credit card for the sum paid (less any taxes and duties for non-EU returns) and less the postal costs.

It is advisable to send returned items by registered post and keep your proof of postage certificate, as we cannot be responsible for goods lost or damaged in transit. Please note that postal costs for returned goods are the customer’s responsibility and will be reimbursed by us only in the case of damaged, faulty or incorrectly supplied goods.

If you qualified for free delivery by spending enough to qualify for a promotional postage discount, and you wish to return an order or part of an order for reasons other than product fault, we will credit you for the returned goods less the value of the free postage.  

If you return a single item bought as part of a multi-buy discount offer (eg Buy One Get One Free, or Buy Two For $60) you will be refunded the full price of the item less the value of the discount given in the offer. If you refund all the items from a multi-buy purchase you will be refunded the price you paid for the goods.

 

If a courier is unable to deliver an item and returns it to the UK, the courier's return charges will be deducted from any refund due.

Customers' statutory rights are unaffected.

Gift Returns
Please note that we can only refund the customer’s original card that payment was made on.

Goods Guarantee
Goods are guaranteed for 14 days against fault (provided the goods have not been used in a manner other than intended) after dispatch to the customer, after this time any faulty goods will be returned to the relevant manufacturer for their independent opinion. Their decision is final any paperwork relating to individual cases will be forwarded to the customer in the event of dispute.


Trademarks and copyright
Our trademarks include (amongst others) the Savile Rogue name and logos. These trademarks may be in use and/or registered in more than one country and your use of and access to our website does not give you any rights to use our trade marks.

Any reproduction or redistribution of Savile Rogue content (including, without limitation the trade marks of Savile Rogue, logos, graphics, text, photos, designs, icons, sounds, music, images, data and software) is prohibited and may result in civil and criminal penalties. Copying and use of any of the Savile Rogue content to any other server, location or support for publication, reproduction or distribution is expressly prohibited. Savile Rogue tries to ensure that all information on this site is accurate and complete.

You may re-copy, extract or forward pages from this website to a third party for their personal use only, provided you:
• Do not make any modifications to the extract or pages before re-copying, extracting or forwarding
• Acknowledge that the extract is from this website

Accessing the website is entirely at your own risk. We are not responsible to you if we are unable to provide our Internet services for any reason beyond our control.

The content of our website is presented, "as is", and we do not guarantee its accuracy, whether explicit or implied. We reserve the right to amend errors, make changes to our website and withdraw any part of our site or to update product information at any time if we consider it necessary.

Online Security
For your security, all Savile Rogue credit card transactions use industry-standard Secure Sockets Layer (SSL) technology to allow for the encryption of potentially sensitive information to and from our site.

The Secure Sockets Layer (SSL) is the standard for secure data transmission over the internet.  When you are asked to fill in your credit card details on our website, your browser will switch to secure mode.  To check if your browser is secure, look at the URL field at the top of your browser.  You will see it begin with https: instead of the normal http: This means you are in secure mode.  You can also verify secure mode by the security icon at the bottom-right hand corner of your browser- usually a lock and key padlock or a solid gold key depending on your browser and version. 

Sensitive data is also not held in clear text on any website or stored on any logos.

Liability and Indemnity
Except in relation to our contractual obligations to supply goods following acceptance of orders placed on our website, neither we nor any of our directors, employees, suppliers or other representatives will be liable in contract, tort, negligence or otherwise for any loss or damage whatsoever in any way connected with your use of the website.

You agree fully to indemnify us, our directors, employees, suppliers or other representatives from and against all liabilities against all claims, liability, damages, losses, costs and expenses, including reasonable legal fees, arising out of any breach of the conditions by you or any other liabilities arising out of your use of this website. We may terminate your use of the website immediately if we consider that you have breached these terms and conditions.
